Sworn Opinion

When You Need an Affidavit

A sworn Egyptian legal opinion for decisions that depend on foreign law.

An Egyptian judgment, inheritance declaration or marriage record may be valid in Egypt but leave a British court, bank or public authority uncertain about its legal effect. A Notarised Egyptian Law Affidavit addresses that difficulty. Prepared by an Egyptian-qualified lawyer, it provides a reasoned opinion in English, identifies the Egyptian rules relevant to the facts, and explains what the supporting documents establish. The purpose is not simply to translate a certificate: it is to give the receiving authority a clear legal explanation it can assess for its particular decision.

  1. Inheritance and Probate

Different rules on succession, inheritance shares and the effect of religious status may require careful explanation. An Egyptian Inheritance Law Affidavit can clarify who is legally recognised as an heir, the significance of an Egyptian declaration of heirs, and how the applicable Egyptian rules affect the estate. For probate applications in England and Wales, Rule 19 of the Non-Contentious Probate Rules 1987 expressly permits consideration of an appropriately qualified person's evidence of foreign law.

  2. Marriage and Personal Status

An overseas authority may need to understand whether a marriage was formally registered in Egypt, what legal effect an informal agreement carries, or how an Egyptian divorce or personal-status judgment should be interpreted. We examine the documents and the applicable legal framework rather than assuming that a relationship recognised elsewhere has the same status under Egyptian law.

  3. Courts and Public Authorities

A solicitor, the Home Office, HMRC, a financial institution or an overseas authority may request an explanation of a specific Egyptian-law question. The affidavit can address the legal consequences of an Egyptian judgment, the status of official records or rights arising under Egyptian legislation, with the scope tailored to the question the recipient actually needs answered.

If an overseas solicitor or institution needs evidence of Egyptian law, send us the specific legal question and relevant records. We can assess whether a Sworn Affidavit of Egyptian Law is appropriate and provide a tailored quotation for your matter.

Egyptian Inheritance Affidavits

Explain Egyptian Succession to Overseas Authorities

Where an estate involves Egyptian assets or succession rules, overseas solicitors and estate administrators may need evidence of what Egyptian law provides—not merely a translation. An Affidavit of Foreign Law for Probate can address a defined question about heirs, entitlement or an Egyptian court record, supported by relevant legal provisions and case documents.

An Egyptian Inheritance Law Affidavit can explain how the applicable Egyptian succession rules allocate an estate among eligible heirs. For example, where sons and daughters inherit together under the relevant rules, a son may receive twice the share of a daughter. We identify the precise family relationships, applicable provisions and any material exceptions, rather than presenting one distribution formula as universally applicable.

The legal opinion is tailored to the estate and the receiving authority’s questions. Its acceptance and evidential weight remain for that authority to determine.

Marriage & Personal Status

A marriage certificate or Egyptian court record may establish a fact without explaining its legal effect to a UK or overseas authority. A Sworn Affidavit of Egyptian Law can explain the applicable marriage and personal status rules, the significance of the documents and the specific issue raised by a solicitor or receiving authority.

Our legal opinions commonly address three questions:

  1. Official Marriage in Egypt

We explain the formalities applicable to the marriage, including registration before an authorised ma'zoun for qualifying marriages or the competent Foreigners' Marriage Office where that procedure applies. The opinion explains the legal significance of the official marriage record.

  2. Unregistered Marriage

An informal or unregistered arrangement must not automatically be treated as an officially registered marriage. We examine the document, the parties' circumstances and the relevant Egyptian law to explain whether, and to what extent, it has legal effect.

  3. Foreign Marriage Recognition

For marriages concluded outside Egypt, we assess the Egyptian-law implications of the foreign certificate and any relevant recognition or registration requirements. If marital status is affected by an Egyptian divorce judgment or official certificate, the opinion can address that evidence as well.

The opinion is supported by relevant records and legal sources and tailored to the recipient's question. Where a sworn, notarised affidavit is required, we coordinate the oath before an independent UK Notary Public and any further legalisation needed for overseas use.

Courts & Official Authorities

Courts, government departments and overseas institutions may need to establish what an Egyptian judgment or official record means under Egyptian law. We prepare a Notarised Egyptian Law Affidavit addressing the specific question, with reference to the relevant legal provisions and evidence.

Courts in England & Wales

An Egyptian Law Affidavit for UK Courts can explain the applicable rules, the effect of Egyptian judgments and the significance of official records. We address the issues identified by the instructing solicitor, subject to the court’s rules on expert and foreign-law evidence.

Home Office Applications

For immigration or nationality applications, an opinion may clarify the legal status of an Egyptian marriage, divorce, family relationship or civil record. We explain Egyptian law without advising on UK immigration requirements or promising acceptance by the Home Office.

HMRC & Estate Matters

An Egyptian Law Affidavit for HMRC can address succession rights, declarations of heirs and the legal significance of Egyptian estate records. UK inheritance tax treatment and reporting remain matters for the client’s UK tax advisers.

Overseas Authorities

International banks, probate lawyers and public authorities may require an Egyptian legal opinion on the documents before them. We agree the questions and destination requirements in advance, arranging notarial certification or further legalisation where needed.

Our Affidavit Process

A Legal Opinion Prepared for Its Intended Use

We prepare each Notarised Egyptian Law Affidavit around the legal questions raised by your solicitor or receiving authority, from reviewing the underlying records to completing the sworn document.

Legal professional reviewing documentary evidence and case materials for an Egyptian law affidavit

Before drafting, we agree the scope, required records and fee, including whether apostille or consular legalisation will be needed. The five stages below show how your instructions progress to the final affidavit.

  1. Case & Document Review

We examine the relevant Egyptian judgments, civil-status certificates and supporting records, identify the legal issue and confirm where the affidavit will be used.

  2. Egyptian Legal Opinion

We prepare an English-language opinion explaining the applicable Egyptian legal provisions and how they relate to the evidence supplied. Our advice is confined to Egyptian law.

  3. Solicitor’s Review

Where a solicitor is instructed, we provide the draft for review against the questions raised in the proceedings or application, while maintaining the independence and accuracy of our legal conclusions.

  4. Swearing & Notarisation

Once the wording is agreed, we arrange for the affidavit to be sworn and signed before an independent UK Notary Public.

  5. Final Document Delivery

We deliver the completed affidavit and coordinate an FCDO apostille or consular legalisation where the receiving authority requires it.

Notarisation & International Use

The formalities for a Notarised Egyptian Law Affidavit depend on its destination. A UK court, an overseas bank and a foreign public authority may require different forms of certification. We check the recipient's instructions before arranging the necessary steps.

Depending on where the document will be submitted, three forms of certification may be relevant:

  1. UK Notarial Certification

The Egyptian-qualified lawyer swears and signs the affidavit before an independent UK Notary Public, who completes the appropriate notarial certificate. Its form should meet the receiving authority's requirements.

  2. FCDO Apostille

Where required for international use, an FCDO apostille authenticates the relevant UK signature, seal or public capacity. It does not endorse or verify the Egyptian legal opinion contained in the document.

  3. Consular Legalisation

Some countries or institutions require embassy or consular legalisation, either alongside an apostille or through a different procedure. We establish the applicable route for the intended destination before proceeding.

Not every affidavit needs an apostille or consular legalisation. Confirming the recipient's requirements first can prevent unnecessary fees and avoidable delays.

Documents Required

To prepare a focused Egyptian law affidavit, we need the records and instructions relevant to the precise legal question. You can send scanned copies for initial review; we will identify whether any certified originals or additional evidence are necessary.

  1. Solicitor’s Instructions icon for documents needed to prepare a notarised Egyptian law affidavit

    Solicitor’s Instructions

Please provide your solicitor’s letter or case summary, if available, setting out the proceedings, the legal issue and the questions the affidavit must answer. Individuals applying directly can explain the purpose in their own words.

  2. Relevant Egyptian Records icon for documents needed to prepare a notarised Egyptian law affidavit

    Relevant Egyptian Records

Send the Egyptian judgments, certificates, declarations, contracts or civil-status records relevant to the question. Clear scans are usually sufficient to begin assessing the documents; we will advise if further evidence is needed.

  3. Facts and Legal Questions icon for documents needed to prepare a notarised Egyptian law affidavit

    Facts and Legal Questions

Provide the key names, dates and circumstances, together with any disputed point requiring clarification under Egyptian law. This helps us distinguish established facts from matters requiring legal interpretation.

  4. Receiving Authority Details icon for documents needed to prepare a notarised Egyptian law affidavit

    Receiving Authority Details

Identify the court, HMRC department, bank or other institution receiving the affidavit, and supply any format, wording or certification instructions it has issued. These requirements determine the scope and final presentation.
