Collect the claim form, statements of case and evidence showing how the defendant was served and represented. Confirm when the appeal period expired, whether any appeal or permission application is pending, and whether the judgment is stayed. A UK court document bearing the required original court seal may be submitted to the FCDO Legalisation Office for a paper Apostille. It should then be presented to the Egyptian Consulate in the United Kingdom, because the consulate requires British documents to be apostilled before consular legalisation.

Four forms of legal standing may support an exequatur application in Egypt.
The applicant must establish a direct legal interest in recognition or execution. The foreign judgment identifies the original creditor, but the Egyptian filing must also prove who currently owns the awarded right and who is legally authorised to act.
The individual or company named in the operative part of the judgment may apply where the awarded right remains vested in that creditor and enforcement is sought against the debtor or assets located in Egypt.
An heir, legal successor or assignee may proceed after proving the transfer of the right through succession documents, an effective assignment or other evidence connecting the applicant to the judgment.
A foreign company acts through a duly authorised representative. Corporate records, current authority and the representative’s capacity should correspond with the legal entity identified in the judgment.
Proceedings may be conducted through an Egyptian lawyer under a Power of Attorney containing sufficient authority to seek recognition, obtain the exequatur order and pursue subsequent execution measures.
Standing should be checked before translation and legalisation begin. A defect in ownership, corporate authority or the Power of Attorney may lead to an inadmissibility objection before the court considers whether the judgment satisfies the enforcement conditions.
Once the foreign judgment file is ready for Egyptian use, the next stage is a court application seeking permission to recognise and enforce it in Egypt. The exequatur process does not retry the original dispute; it determines whether the foreign judgment satisfies the Egyptian enforcement conditions.
The judgment, parties, legal standing and requested relief are reviewed together. The assessment should also identify the debtor’s Egyptian address, any known assets and the place where enforcement is expected, allowing the competent Egyptian court and the correct procedural route to be confirmed.
The application is filed before the competent Court of First Instance with the foreign judgment, supporting certificates, Arabic translations, evidence of standing and the Power of Attorney. The requested order should identify the judgment and the obligation for which enforcement is sought.
The defendant is formally served with the Egyptian proceedings and given the opportunity to appear and raise objections. Accurate names and addresses matter, because defective service in Egypt may delay the case independently of whether service in the original foreign proceedings was valid.
The court examines jurisdiction, proper notice, finality, consistency with Egyptian judgments, public policy and any applicable reciprocity or treaty framework. It is not an appeal against the foreign decision and should not reconsider the underlying evidence merely because one party disputes the result.

The exequatur proceedings are not a new trial of the original claim. The Egyptian court does not ordinarily rehear witnesses, reassess the commercial evidence or replace the foreign court’s factual findings merely because the judgment debtor disagrees with the outcome.
Its review is directed to the Egyptian enforcement requirements, including jurisdiction, proper notice and representation, finality, consistency with earlier Egyptian judgments and compliance with Egyptian public policy. Objections should therefore address those recognition conditions rather than repeat the original defence.

Identifiable Egyptian assets are not necessarily the only reason to seek recognition, but they are highly important where the objective is actual financial recovery. A favourable exequatur order cannot produce payment by itself when no attachable money, property or third-party debt can be located within the reach of Egyptian enforcement procedures.
Before substantial costs are incurred, it is sensible to consider the debtor’s Egyptian address, bank relationships, real estate, business interests and other potential assets. Ownership, prior securities, competing creditors and statutory protections may all affect whether a particular asset can provide meaningful recovery.
