Protecting Your Right to Compensation Under Egyptian Civil Law :-

In Egypt, torts and compensation are governed by the Egyptian Civil Code (Law No. 131 of 1948). This legal area addresses the harm one person causes to another. A. What is a Tort Under Egyptian Law?

According to Article 163 of the Egyptian Civil Code, “Any fault which causes harm to another obliges the person in fault to make compensation.”

B. Types of Compensation Claims You Can File :-

The law allows individuals to file compensation claims in various cases, including:

  • Traffic Accidents
    Victims of car accidents can claim for medical costs, disability, emotional harm, and vehicle damage. The claim must prove fault and harm.

  • Workplace Injuries
    If an employer fails to provide safety measures and an employee gets injured, the worker has the right to compensation under labor law and tort law.

  • Medical Negligence
    Patients harmed by a doctor’s error, misdiagnosis, or malpractice can pursue damages in court. However, expert reports are often required.

  • Property Damage
    Unlawful destruction or damage to personal or business property gives rise to civil liability.

  • Defamation & Verbal Abuse
    Harm to reputation or mental well-being caused by false accusations or insults can also justify a tort claim.

C. How the Court Decides Compensation :-

  1. Fault (خطأ)

  2. Damage (ضرر)

  3. Causal Link (العلاقة السببية)

All three must be present. Compensation may cover material (economic) and moral (emotional) damages. The amount depends on the severity of the harm, the victim’s situation, and the degree of fault.

D. Legal Procedures and Deadlines :-

You must file the claim within three years from the date of the damage or discovery of the harm. Cases are usually filed in civil courts or summary courts depending on the amount of compensation.
